The rules for using the JBay Waves website, surf reports and downloads.

Welcome to JBay Waves. These terms apply to your use of this website, including the surf reports, forecasts, articles, news pages, AI tools, free downloads and newsletter. By using the site, you agree to them. If you don't agree, please don't use the site.
1. About us
This website is run by JBay Waves, a surf brand based in Jeffreys Bay, Eastern Cape, South Africa. You can reach us at jbaywavess@gmail.com or through our contact page.
2. Surf forecasts and ratings are estimates
Our surf reports, forecasts, surf heights, wind descriptions, tide times, water temperatures and 0 to 6 ratings are generated automatically from computer-model data supplied by third parties. They are estimates, not observations or guarantees, and the ocean can change quickly. Conditions at the beach may be very different from what the forecast shows.
The ocean is dangerous. Always assess the conditions yourself before entering the water, surf and swim within your ability, follow the instructions of lifeguards, and obey local warnings, flags and beach closures. Never rely on this website as your only source of safety information.
To the fullest extent permitted by law, JBay Waves is not liable for any loss, injury or damage arising from decisions you make based on forecasts, ratings or other information on this site.
3. AI-generated content
Some content on this site is created with the help of artificial intelligence, including forecast summaries, answers from the "Ask the surf AI" assistant and some written content. AI can make mistakes, misread data or state things confidently that are wrong. Treat AI answers as general information only, check anything important, and never use them in place of your own judgement, local knowledge or professional advice.
4. Our content
Unless stated otherwise, the text, guides, illustrations, logos, designs and other material on this site belong to JBay Waves and are protected by copyright and trade mark law. You may view, print or share links to our pages for personal, non-commercial use. You may not copy, republish or sell our content without our written permission.
Some material belongs to others and is used with credit. Forecast data is provided by Open-Meteo under its own licence, map data comes from OpenStreetMap contributors, and news headlines, excerpts and images remain the property of their publishers.
5. Acceptable use
When you use this site, you agree not to:
- use it for anything unlawful, harmful or fraudulent;
- send spam, abusive or offensive messages through our forms;
- try to gain unauthorised access to the site, its admin area or its systems, or interfere with how it works;
- scrape or copy large amounts of data, or overload the site with automated requests;
- misuse the AI assistant, including trying to get around its limits or using it to create harmful content.
We may block access or remove content that breaks these rules.
6. Links to other websites
This site links to other websites, including the JBay Waves online store at jbaywaves.store, which runs on Shopify, and the surf news sources whose headlines we show. Those sites have their own terms and privacy policies. We don't control third-party websites and are not responsible for their content, products or services. Purchases from our store are governed by the store's own terms and policies.
7. Free downloads
Our free PDF guides are for your personal, non-commercial use. You are welcome to download, print and keep them, and to share the link to the download page with friends. Please don't sell them, republish them, upload them elsewhere or remove our branding. The safety and surf advice in the guides is general information, so the warnings in section 2 apply to them too.
8. The newsletter
The JBay Waves newsletter is free and sent only to people who subscribe and confirm their email address. You can unsubscribe at any time using the link in every email. How we handle your information is explained in our privacy policy.
9. Availability and changes
We work hard to keep the site running and the information current, but we can't promise the site, its forecasts or its tools will always be available, complete or error-free. We may change, suspend or remove any part of the site at any time.
10. Limitation of liability
The site and its content are provided "as is". To the fullest extent permitted by law, JBay Waves is not liable for any indirect or consequential loss, or for any loss arising from your use of, or inability to use, the site. Nothing in these terms limits any rights you have under the Consumer Protection Act, 2008, or any other law that cannot be excluded.
11. Governing law
These terms are governed by the laws of the Republic of South Africa, and any dispute will be subject to the jurisdiction of the South African courts.
12. Changes to these terms
We may update these terms from time to time. The date at the top shows when they were last changed, and by continuing to use the site you accept the current version.
